Abstract

This thesis discusses the guarantee of the fulfillment of women's rights after divorce in the Class 1B Religious Court of Lubuk Linggau. After a divorce occurs, rights in the form of maintenance for women must be provided by the former husband. The fulfillment of women's rights after divorce has become a concern for the author, emphasizing that these rights must be met. This research will also answer all research questions, namely how the fulfillment of women's rights after divorce is carried out at the Class 1B Religious Court of Lubuk Linggau, and what factors hinder the fulfillment of women's rights after divorce at the same court?. This study is a normative empirical research, with Mr. Ahkam Riza Kafabih, S.HI, serving as the source, as he is a judge at the Lubuk Linggau Religious Court. The research was conducted at the Class 1B Religious Court of Lubuk Linggau. The primary data source came from interviews, while secondary data came from relevant legal documents such as laws, books, and journals. The research shows that the Lubuk Linggau Religious Court has made efforts to fulfill women's rights after divorce as maximally as possible, based on the applicable laws and regulations. However, there are still several obstacles in implementing these efforts, such as the lack of revealed facts during hearings, the economic condition of the former husband, and the awareness of both parties regarding their obligations. The Lubuk Linggau Religious Court, under the auspices of the Supreme Court, continues to strive to ensure the fulfillment of women's rights after divorce.
