Tindak Pidana Penghinaan Citra Tubuh (Body Shaming) dalam Pasal 315 KUHP Perspektif Hukum Pidana Islam

Abstract: Body shaming has a meaning as a negative attitude or behavior toward other people regarding weight, body size, or appearance. The act of body shaming can hurt the feelings and mentality of the victims either directly or indirectly and apart from saying verbal sentences, nowadays body shaming is often carried out through platforms such as social media. Body shaming is included in criminal acts that can trap the perpetrators as written in Article 315 of the Criminal Code which regulates acts of insulting body image with criminal sanctions in prison and fines. Thus, this regulation creates legal protection for victims of body shaming themselves. Besides that, in a review of Islamic criminal law, perpetrators of body image insults (body shaming) are included in the perpetrators with a ta'zir where punishment and sanctions can be handed over to the authorities.
Abstrak: Body shaming memiliki arti sebagai sikap atau perilaku negative terhadap orang lain baik mengenai berat badan, ukuran tubuh, atau penampilan. Tindakan body shaming dapat melukai perasaan dan mental para korban baik dilakukan secara langsung maupun tidak langsung dan selain daripada mengucap kalimat verbal, saat ini seringkali body shaming dilakukan melalui platform seperti media sosial. Body shaming termasuk kedalam tindakan pidana yang mampu menjerat para pelaku sebagaimana yang tertulis didalam Pasal 315 KUHP yang mengatur mengenai tindakan penghinaan citra tubuh dengan sanksi pidana penjara dan denda. Maka, dengan adanya peraturan ini tercipta suatu perlindungan hukum bagi korban body shaming itu sendiri. Disamping itu, didalam tinjauan hukum pidana Islam, pelaku penghinaan citra tubuh (body shaming) termasuk kedalam pelaku dengan jarimah ta’zir yang dimana hukuman dan sanksi nya dapat diserahkan kepada para penguasa.
